Acceptance of Terms

By accessing or using the Builder Intelligence website and services operated by Leap21 LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use our services.

Description of Service

Builder Intelligence is an AI-powered construction intelligence platform currently in development. By signing up for our waitlist or pilot program, you are requesting early access to our platform. We reserve the right to accept or deny any application at our discretion.

User Obligations

When using our services, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Not use the service for any unlawful or prohibited purpose
• Not attempt to gain unauthorized access to any systems
• Not interfere with or disrupt the service or servers
• Not transmit any viruses, malware, or harmful code

Intellectual Property

All content, features, and functionality of the Builder Intelligence platform, including but not limited to text, graphics, logos, and software, are owned by Leap21 LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Beta/Early Access Program

Our platform is currently in beta/early access. By joining our waitlist or pilot program, you acknowledge that:

• The service may contain bugs, errors, or inaccuracies
• Features may change or be removed without notice
• We do not guarantee uninterrupted or error-free operation
• Your data may be lost or corrupted

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the service will meet your requirements or be uninterrupted, secure, or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAP21 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Leap21 LLC and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of the State of Florida.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
